Membership

1. Free Membership. No purchase is necessary to obtain membership in the Meineke Rewards Program (hereinafter, the "Program") offered herein by MEINEKE FRANCHISOR SPV LLC ("Meineke").
2. Enrollment. You may enroll in the Program by opening an Account (defined below) for which you will be required to provide your first name, last name, mailing address, phone number, and email address. Members (defined below) agree to receive email messages, phone call, and text messages (including messages containing marketing materials and commercial offers) as part of their enrollment for so long as they are a Member and further consent to receive automated promotional text messages from Meineke sent via automated dialing/sequencing systems, even if their phone number is on a Do-Not-Call list for so long as they continue to be a Member. The Program is void where prohibited by law. Members are entitled to only one Program membership account (an "Account"). Neither your Points (defined below) nor your Account may be sold, transferred or assigned to others. You may apply for an Account at a participating Meineke location, on the Meineke website (www.meineke.com) (hereinafter, the "Website"), or the My Meineke app. You acknowledge that Meineke is an automotive aftermarket franchising company and Meineke locations are independently owned and operated. Meineke locations are given the option to participate in the Program and may choose to not to participate in the Program. The Program is valid at participating Meineke locations only. During any period that you have an Account you shall be a "Member" and shall be deemed to be participating in the Program. For further clarity, you may not participate in the Program without an Account. Meineke reserves the right to deny participation in the Program by any individual for any reason. Only natural persons may have an Account.
3. Eligibility. You must be age eighteen (18) years or older and a resident of the United States of America to be eligible to be a Member. You may only become a Member if you are a natural person. By signing up for the Program, you agree (i) that you are over the age of eighteen (18), (ii) that you reside in the United States of America, (iii) that you are a natural person, and (iv) to be bound by these terms and conditions (these "Terms").
4. Access/Change Member Information/Cancellation. Members must keep their personal information on their Account updated and accurate. This can be done online at the Website, on the My Meineke app, or by calling the customer service number at 1 (800) 447-3070 (hereinafter, "Customer Service"). Once you are a registered user of the Website, you may view a summary of your Account on the Website. After logging onto the Website, simply click on the "My Account" link in the header of the Website homepage and change any information on your account. You may cancel your Program membership at any time by calling Customer Service. Upon cancellation, any unused Points accrued in your account will be forfeited and cannot be redeemed and you will no longer be eligible for any Program benefits.

Earning points

1. Earning Rate. Subject to the terms hereof, a Member can earn Points on the Qualifying Purchases (defined below). Generally, subject to the terms hereof, Members earn ten (10) points ("Points") for every one dollar ($1) spent on Qualifying Purchases. Points earned for Qualifying Purchases will be credited in real time upon the completion of your purchase. The timing for issuing Points is subject to change.
2. Exclusions. "Qualifying Purchases" shall mean all purchases of automotive aftermarket parts and services from a Meineke location other than:
   • Any amounts paid by a Member for taxes, including without limitation, federal, state, and local taxes or use taxes;
   • Amounts not actually paid by a Member (including due to discounts or other credits offered in connection with a product or service);
   • Any amounts paid by a Member for Shop Supply Fees, Disposal Fees, and Environmental Fees;
   • Any amounts paid by a Member to a Meineke location that is not a participating Meineke location;
   • Any amounts paid by a Member prior to such Member joining the Program.
3. Reduction in Points. Points earned for a purchase that is then the subject of a refund, returned check due to non-sufficient funds, or other credit will be deducted from the Member's Account in an amount equal to the points earned for the original transaction. If a return will cause your Account to have a negative point balance, a zero Point account balance will be placed into your Account and Meineke may, at its option, terminate your Account.
4. Expiration. All Points that are available in a Member’s Account on a Cutoff Day (defined below) shall be deemed forfeited (and the total amount of Points held in such Account reduced to zero (0)) at any time such Member has failed to make a Qualifying Purchase recorded on such Member’s Account for a period lasting three hundred sixty-five (365) days. As used herein, "Cutoff Day" shall mean the last day of such three hundred sixty-five (365) day period.

Redeeming points

Points may only be redeemed on Qualifying Purchases at a participating Meineke locations (See Section II(2) for the definition of Qualifying Purchases, which excludes, among other things (i) taxes including without limitation, federal, state, and local taxes or use taxes, and (ii) Shop Supply Fees, Disposal Fees, and Environmental Fees). Value of the Points with respect to Qualifying Purchases shall be as follows:

2,500 points = $5 Off

5,000 points = $10 Off

10,000 points = $20 Off

15,000 points = $30 Off

20,000 points = $40 Off

25,000 points = $50 Off

50,000 points = $100 Off

Points may only be used in the quantities listed above. No more than 50,000 Points may be used on a single transaction. Points have no cash value and if used in excess of the value of the Qualifying Purchases in a transaction, no cash will be due to the Member using such Points. Points from a Member’s Account may only be used for a maximum of one transaction per day.

Free Towing

Members are entitled to free towing to a participating Meineke location from locations within 5 miles of such participating Meineke location. The offer in this Article IV (i) is only valid in the United States of America and Puerto Rico, (ii) is limited to 5 tows per Account, (iii) limited to select cars and light trucks (as determined by Meineke from time to time in its sole discretion), (iv) may only be used for a vehicle registered to the Member or someone living in the Member’s home, and (v) may not be used for a vehicle primarily used in connection with a business.

General

By becoming a Member, you agree to be bound by these Terms. Meineke reserves the right to cancel, modify, or restrict any aspect of the Program and the Terms, including, without limitation, the Point conversion ratio and the Point expiration policy, at any time. Any changes to these Terms can be made by Meineke without advance notice and any such changes would be stated in an updated version of these Terms available on the Website. Meineke may make changes to these Terms even if such changes affect your ability as a Member to use Points that you have accumulated prior to such changes. You are responsible for remaining knowledgeable about these Terms, so review these Terms regularly. Meineke reserves the right to determine the amount of Points in any Member's account based on Meineke's internal records related to such Member's Account. In the event of an inconsistency between the amount of Points showing as accrued on the Website with respect to a Member's Account and Meineke's internal records, Meineke's internal records will control. Meineke assumes no responsibility for errors caused by acts or omissions of a Member. Neither the Points nor your Account are transferrable. Use of the Points is strictly limited as provided in these Terms. Meineke may revoke any Member's membership in the Program (by terminating such Member’s Account) at any time if such Member violates these Terms. Notwithstanding anything to the contrary herein, Meineke may terminate a Member’s Account at will and without cause. Points have no cash value.
